Agreement to these terms
These Terms of Use ("Terms") govern your access to and use of daily-peaks.com (the "Site"), operated by Daily Peaks ("Daily Peaks," "we," "us," or "our"). By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.
The Site publishes educational content about day hikes, weekend trails, packing, weather judgment, and related outdoor topics. It is not a substitute for professional outdoor safety instruction, medical advice, or legal counsel. Important disclaimers also appear on our Legal Notices page and throughout the blog.
Changes to the Site and Terms
We may update the Site, these Terms, or both at any time. When we change Terms materially, we will update the date at the top of this page. Continued use after changes constitutes acceptance of the revised Terms. If you disagree with changes, stop using the Site.
Trail conditions, regulations, and access rules change frequently in the real world faster than we can update every sentence. Content may become outdated despite our editorial efforts. You are responsible for verifying current conditions with official land managers before traveling.
Eligibility and accounts
The Site is intended for a general audience. If you are under the age required in your jurisdiction to enter a binding agreement, you may use the Site only with involvement of a parent or guardian who accepts these Terms on your behalf.
Some features—such as email newsletters—may require you to submit an address or other information. You agree to provide accurate information and to keep it updated where practical. You are responsible for maintaining the confidentiality of any credentials associated with third-party services linked from the Site.
Permitted use
You may browse, read, and share links to Site content for personal, non-commercial educational purposes, subject to these Terms and applicable law. You may quote brief excerpts with attribution and a link to the original page where reasonable.
You may not:
- Use the Site in any manner that violates applicable law or third-party rights
- Attempt to gain unauthorized access to systems, accounts, or data
- Scrape, crawl, or harvest content at a scale that impairs Site operation
- Republish full articles or substantial portions for commercial republication without written permission
- Remove copyright, trademark, or attribution notices
- Transmit malware, spam, or automated queries intended to disrupt service
- Misrepresent your affiliation with Daily Peaks or imply endorsement without consent
Intellectual property
Site design, branding, selection, arrangement of content, and original text are protected by copyright and other intellectual property laws. "Daily Peaks" and associated logos are trademarks of Daily Peaks. Other names and marks appearing on the Site belong to their respective owners.
Licensed photography and illustrations remain subject to their licenses; do not reuse media from the Site unless expressly permitted. User-generated comments, if enabled in the future, may be moderated or removed at our discretion.

User submissions and feedback
If you email us corrections, suggestions, or other feedback, you grant Daily Peaks a non-exclusive, royalty-free license to use that feedback to operate and improve the Site without obligation to compensate you. Do not submit confidential or proprietary information you expect to remain secret.
We welcome trail corrections tied to verifiable sources. We are not required to publish every suggestion. Editorial decisions remain with Daily Peaks.
Third-party links, tools, and affiliates
The Site links to third-party websites, maps, retailers, and services we do not control. Those sites have their own terms and privacy practices. A link is not an endorsement unless explicitly stated.
Some product links may be affiliate links, meaning Daily Peaks may earn a commission if you purchase through them. Affiliate relationships do not increase the price you pay through that link. We describe affiliate use further on Legal Notices and in our Privacy Policy where relevant.
Educational content disclaimer
All Site content is for general educational purposes only. Daily Peaks is not a guide service, rescue agency, medical provider, or law firm. Content may contain errors or become outdated. Weather, wildlife, trail damage, and closure orders can change conditions within hours.
You assume all risks associated with outdoor activities you undertake based on or independent of Site content. You are solely responsible for your preparation, equipment, route choices, turnaround decisions, and compliance with local laws and land-manager rules.
Nothing on the Site creates a professional-client, guide-client, doctor-patient, or attorney-client relationship. For hands-on skills such as wilderness navigation, avalanche assessment, or swift-water crossing, seek qualified in-person instruction appropriate to your environment.
No warranties
THE SITE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS.
Some jurisdictions do not allow exclusion of certain warranties; in those jurisdictions, our exclusions apply to the fullest extent permitted by law.
Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, DAILY PEAKS AND ITS OWNERS, EMPLOYEES, CONTRACTORS, AND CONTRIBUTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SITE OR CONTENT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) ONE HUNDRED U.S. DOLLARS (US$100) OR (B) THE AMOUNT YOU PAID US, IF ANY, IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
Some jurisdictions do not allow limitation of liability for personal injury or certain damages; in those jurisdictions, our limitation applies to the fullest extent permitted by law.
Indemnification
You agree to defend, indemnify, and hold harmless Daily Peaks and its personnel from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from your use of the Site, your violation of these Terms, your violation of any law or third-party right, or outdoor activities you undertake.
Termination
We may suspend or terminate access to the Site, in whole or in part, at any time for any reason, including maintenance, security concerns, or violation of these Terms. Sections that by their nature should survive termination—including intellectual property, disclaimers, limitation of liability, indemnification, and governing law—will survive.
Governing law and disputes
These Terms are governed by the laws of the United States and the state in which Daily Peaks primarily operates, without regard to conflict-of-law rules that would apply another jurisdiction's laws. You agree that exclusive jurisdiction for disputes arising from these Terms or the Site resides in the courts of that state, unless applicable law requires otherwise.
Before filing a formal dispute, you agree to contact us at hello@daily-peaks.com and attempt to resolve the matter informally within thirty days.
Miscellaneous
If any provision of these Terms is held invalid, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not assign your rights under these Terms without our consent; we may assign ours in connection with a merger, acquisition, or asset sale.
These Terms, together with the Privacy Policy and incorporated Legal Notices, constitute the entire agreement between you and Daily Peaks regarding the Site.

Outdoor activity acknowledgment
By using educational hiking content on the Site, you acknowledge that trail difficulty ratings are subjective, that fitness and experience vary widely, and that written guides cannot replicate on-the-ground judgment. You agree to carry appropriate equipment, tell someone your plan where prudent, and comply with posted closures even if an article has not yet been updated to reflect them.
Children and dependent companions are your responsibility. Daily Peaks articles may describe family-oriented routes, but only you can judge whether a child's stamina, fear of exposure, or medical needs fit a given day.
Electronic communications
When you contact us or subscribe to email, you consent to receive communications electronically. You agree that electronic notices satisfy any legal communication requirements to the extent permitted by law. You may opt out of marketing email without affecting access to the public Site.
Copyright and DMCA alignment
We respect intellectual property rights. Procedures for copyright complaints are described on Legal Notices. Repeat infringers may lose access to interactive features if such features are offered in the future.
Severability and interpretation
Headings are for convenience only. "Including" means "including without limitation." These Terms are written in English; translated versions, if any, are provided for convenience and the English version controls to the extent allowed.
Nothing in these Terms limits rights that applicable consumer protection laws grant you that cannot be waived by contract.
User-generated comments and community features
If Daily Peaks enables comments, forums, ratings, or other user-generated content ("UGC") on the Site or through linked social channels moderated by us, you remain solely responsible for what you post. Do not post content that is unlawful, defamatory, harassing, invasive of privacy, infringing intellectual property, or that encourages unsafe or illegal trail behavior—including trespass, ignoring closures, wildlife harassment, or route descriptions that omit material hazards you know about.
By submitting UGC, you grant Daily Peaks a worldwide, non-exclusive, royalty-free, sublicensable license to use, reproduce, modify, adapt, publish, display, and distribute that content in connection with operating and promoting the Site, without compensation to you. You represent that you own or have rights to submit the content and that it does not violate any third-party rights. We may remove, edit, or refuse to display UGC at any time without notice, including comments that appear to give professional rescue, medical, or legal advice, that contain affiliate spam, or that include personal data about other people without consent.
UGC reflects the views of individual posters, not Daily Peaks. We do not pre-screen every comment and are not responsible for opinions, route beta, or gear recommendations posted by readers. Never treat a comment thread as a substitute for official land-manager alerts, qualified instruction, or your own field judgment.
DMCA copyright policy
Daily Peaks respects copyright law and expects users to do the same. If you believe material on the Site infringes your copyright, send a DMCA notice to hello@daily-peaks.com with the subject line "DMCA Notice." Include: (1) your physical or electronic signature; (2) identification of the copyrighted work; (3) identification of the infringing material and its URL; (4) your contact information; (5) a statement of good-faith belief that use is unauthorized; and (6) a statement under penalty of perjury that your notice is accurate and you are authorized to act on behalf of the copyright owner.
We may remove or disable access to contested material and notify the user who posted it, if applicable. Repeat infringers may have commenting privileges or other interactive access terminated. If you believe your material was removed in error, you may submit a counter-notification with the elements required by 17 U.S.C. § 512(g). We will process notices in accordance with applicable law. Misrepresentations in a DMCA notice or counter-notice may expose you to liability.
Jurisdiction, venue, and outdoor recreation context
These Terms are governed by the laws of the United States and the state in which Daily Peaks primarily operates, without regard to conflict-of-law principles that would apply another jurisdiction's substantive law. You agree that exclusive venue for disputes arising from these Terms or your use of the Site lies in the state and federal courts located in that state, unless applicable law requires a different forum. Nothing in this section limits mandatory consumer protections or rights you cannot waive where you live.
Outdoor recreation laws vary by country, state, province, tribal land, and local ordinance. Site content may reference rules familiar to U.S. public-land visitors; those summaries do not transfer automatically to other regions. When you hike outside the areas our guides describe, you—not Daily Peaks—must identify controlling law, permit systems, and emergency numbers.
